HomeMy WebLinkAboutAgenda Report - April 1, 1992 (56)CIN OF LODI AGENDA TITLE: Public Hearing to Accept Cost of Construction Report and Hear Objections From Propertv Cwners Liable to be Assessed for Installation of Sidewalks at 1907 and 1911 South Church Street MEETING DATE: April 1. 1992 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council do the following: 1) Receive and confirm the attached Report of Costs; 2) Hear any objection or protests from property owners liable for assessment for the installation of a sidewalk; 3) If there are no objections or if the objections are overruled. adopt a resolution confirming the Report of Costs and assessment against the real property; and 4) Order preparation of Notice of Lien and direct the City Clerk to f i l e the I i e n i f assessment i s not paid within the five days allowed in the Streets and Highways Code. BACKGROUND INFORMATION: As part of the Church Street reconstruction project, 300' N/Century Boulevard to Kettleman Lane, four property owners were notified to construct sidewalk where none existed. At the time the contract was awarded for the Church Street reconstruction project, all four property owners were notified of the cost i1F'the City's contractor did the work. Two of the property owners made arrangements for the sidewalk installation and two did not. Before the City had its contractor install the sidewalk, those owners who had not made arrangements for the installation of the sidewalk were again notified that, if it was not done within the time frame allowed in the Streets and Hiqhways Code, our contractor would do it. The City's contractor installed the sidewalk on two properties where the owners did not. After the project was completed. those property owners who had not installed the sidewalk on their own were given a courtesy letter stating the amount of the sidewalk installation and informing them that the procedure to start the lien process would begin i f vie had not heard from them i n th i rty days. One of the letters sent to the property owner had an incorrect amount on it. That error was not discovered until past the time to begin the lien process. The property owner had not contacted the City or made arrangements to pay this bill until after the thirty days and the property was posted. The correct amount of the cost of construction was on the posting and was again sent to the owner. At that time. the property owner paid the lower, incorrect amount. The property owner was notified within an hour after he paid the b i I I that i t was an improper amount and that the amount. shown on the Report of Costs, which was posted on the property and mailed to him. was the proper amount. Attached is a copy of the letter of explanation that went to the property owner. Streets and Highways Code Section 5883 requires that a public hearing be held to hear and pass upon the Report of Costs and to hear protests which may be raised by property owners. After the public hearing the Council shall confine the Report of Costs. assess the cost of construction to the affected properties and order the preparation of a notice of lien to be filed with the tax collector if, after being billed, the property owner does not pay the bill within five days. The bill enclosed with this letter is in the mount of 54,200.75 less payment evade of 52,800.50, leaving a balance of $1,400.25. Also enclosed is copy of the Council nlcation from the City manager stating that the public hearings which were scheduled for Mamh 18 have been postponed until April 1. Became of this postponement, it will be ne^.essary for us to again notify you of the public hearing and post the property. Gutter and Sidewalk Installation at 1911 South Church Street APR 062-020-23 At its meeting of April 1, 1992, the City Council confirmed the assessment against the real property for the curb, gutter and sidewalk that was installed by the City in front of your property. Enclosed is a bill in the amount of $1,400.25 which is the difference between the actual cost of installation and the amount you paid on March 12, 1992. If the property is liened because this bill is not paid, the administrative cost shown on the enclosed Report of Cost, dated March 20, 1992. will be added. Section 5890 of the Streets and Highways Code provides that the property owner will be given five days in which to pay this assessment. Ifthe bill is not paid within that time. a notice of lien will be turned over to the lax Collector and this amount will be collected with your next year's property taxes.
