AGENDA TITLE: Purchase of Property at 13 N. Church Street
MEETING DATE: March 4, 1992

RECOMMENDED ACTION: That the City Council concur in the purchase by the
City of the property at 13 N. Church Street.
BACKGROUND INFORMATION: For many years the City has expressed interest in the
purchase of the property at 13 N. Church Street
(Viola's), oww, d by Mrs. Viola Reiswig. The property
is surrounded on three sides by City property as is the sole remaining parcel
to be acquired to complete the Civic Center complex. The property will be
utilized for additional parking. About a year ago, the City engaged the
services of an appraiser to prepare a formal appraisal of the property. The
appraised value was set at $100,000. In a meeting late in the afternoon of
February 27, 1992 (Thursday), Mrs. Reiswig accepted the City's offer at the
appraised value.
Mrs. Reiswig is anxious to close escrow on the property at the earliest
possible date. It is for this reason that this matter is brought to the City
Council for concurrence now rather than waiting until the next regular meeting
of March 18. 1992. Funding is provided in the 1991-92 Capital Improvement
Budget previously approved by the City Council.
Attached (Exhibit A) is a copy of the letter to Prs. Reiswig acknowledging her
acceptance of the City's offer.

This letter w i I I confirm your acceptance of the offer of the City of
Lodi to purchase the property you own at 13 N. Church Street. The
purchase price is $100,000 net to you. The City w i l l pay a I I costs
associated with the transaction. This offer assumes there are no taxes
or liens on the property. It is agreed that any unpaid taxes or liens
on the property are your responsibility to be paid prior to the City
taking possession of the property.
You will receive a check in the amount stated above at the close of
escrow. You have requested until Mry 1, 1992 to remove your personal
property from the building and this is agreeable to the City. You also
have requested to remove certain fixtures, cabinet:. doors and other
installations fnm the building and this too is agreeable to the City.
Please don't hesitate to contact me should you have any questions. I
have instructed rry staff to proceed with the preparation of the
necessary paperwork. I w i I I be i n touch with you as soon as your
signature is needed on the various documents.
I am very pleased that we have been able to reach agreement on this
