HomeMy WebLinkAboutAgenda Report - November 19, 2008 E-13AGENDA ITEM E043 CITY OF LODI COUNCIL COMMUNICATION TM AGENDA TITLE: Adopt Resolution Accepting Improvements at 416, 500 and 540 South Sacramento Street and Appropriating Funds for Required Reimbursements ($122,298) MEETING DATE: November 19,2008 PREPARED BY: Public Works Director RECOMMENDED ACTION: Adopt a resolution accepting improvements at 416, 500 and 540 South Sacramento Street and appropriating funds for required reimbursements as shown below. BACKGROUND INFORMATION: Improvements at 416,500 and 540 South Sacramento Street have been completed insubstantial conformance with the requirements of the improvement agreement between the City of Lodi and Glenn E. Camper and Janis B. Camper, Trustees of The Camper Family Trust, as approved by the City Council on May 21,2008, and as shown on City of Lodi Drawings Nos.005D001-01 through005D001-04. The improvements included the reconstruction and widening (14 feet) of the east half of Sacramento Street from Tokay Street to 200 feet south of Chestnut Street. Since the entire width of this section of Sacramento Street was in very poor condition, the City requested that the developer reconstruct the west half of Sacramento Street as part of this project. The developer is entitled to reimbursement by the City for reconstructing the west half of Sacramento Street in conformance with Lodi Municipal Code 16.40 Reimbursementsfor Construction. Staff is now requesting the appropriation of the funds listed below to cover the reimbursementto be paid by the City to the developer. Council approved an appropriation of $64,300 for this project on May 21, 2008. These funds were used to replace portions of the curb, gutter and sidewalk along the west side of Sacramento Street before the developer's contractor began his street improvementwork. The new curb, gutter and sidewalk allowed the contractor to tie his work into new concrete that was not broken or settled and that was set at the proper grade. FISCAL IMPACT: Per Item 17, "Repair or Reconstruction of Defective Work", of the improvement agreement, the developer's warranty period of one year will begin on the date of Council acceptance, There will be a slight increase in long-term maintenance costs for the new public improvements. That all requirements of the Improvement Agreement between the City of Lodi and Glenn E. Camper and Janis B. Camper, Trustees of the Camper Family Trust, for the improvements at 416, 500, and 540 South Sacramento Street have been substantially complied with. The improvements are shown on Drawing Nos. 005DO01-01 and 005DO01-04 on file in the Public Works Department and as approved by the City Council on May 21, 2008. 2. No new City streets were dedicated as part of this project. BE IT FURTHER RESOLVED that funds in the amount of $122,298 be appropriated from the Street Fund to cover the reimbursement to be paid by the City to the developer in conformance with Lodi Municipal Code 16.40 Reimbursement for Construction.
