AGENDA TITLE: Adopt Resolution Authorizing Public Works Director, City Engineer or
Senior Civil Engineer to Execute Subdivision and Parcel Maps and Accept
Dedications on Parcel Maps

RECOMMENDED ACTION: Adopt a resolution authorizing the Public Works Director,
City Engineer or Senior Civil Engineer, if such persons were
registered as a civil engineer priorto January 1, 1982, pursuantto
the Professional Engineers' Act (Chapter 7 of Division 3 of the
Business and Professions Code), to execute subdivision and parcel maps and accept dedications on
parcel maps on behalf of the City.
BACKGROUND INFORMATION: The Council previously adopted Resolution No. 94-26 (attached)
authorizing the Public Works Directorand City Engineerto execute
subdivision and parcel maps and accept dedications on parcel maps
on behalf of the City. The resolution also authorized the
Senior Civil Engineerto act in their place in their absence.
The Subdivision Map Act (Sections 66442 and 66450) requires certification statements on final
subdivision and parcel maps to be signed by the City Surveyor, City Engineer or other public official or
employee qualified and authorized to act on their behalf. In addition, pursuantto the Professional
Engineers' Act (Chapter 7, Division 3, commencing with Section 6700, of Division 3) only persons
registered as a civil engineer prior to January 1, 1982, are qualified to sign the certification statements.
The City has no City Surveyor and the City Engineer position is currently vacant. The current
Public Works Director is a registered engineer in the State of California but received his license in 1984
It is, therefore, necessary to either authorize other current City staff holding the position of Senior Civil
Engineer and registered as a civil engineer prior to January 1, 1982, to execute subdivision and parcel
maps and accept dedications on parcel maps on behalf of the City or to contract this service with a
private engineering firm.
Staff recommendsthat the Council adopt the resolution as proposed. This resolutionwould supercede
Resolution No. 94-26.
FISCAL IMPACT
FUNDING AVAILABLE:
Allows current City staff to execute subdivision and parcel maps in lieu of
contracting this service with a private engineering firm.

RESOLUTION NO. 94-26
A RESOLUTION OF THE LODI CITY COUNCIL
AUTHORIZING THE CITY ENGINEER OR THE SENIOR
CIVIL ENGINEER TO EXECUTE SUBDIVISION AND PARCEL MAPS
IN THE ABSENCE OF THE PUBLIC WORKS DIRECTOR
RESOLVED, that the City Council of the City of Lodi does hereby
authorize the Public Works Director and the City Engineer on behalf of
the City to execute subdivision and parcel maps and to accept
dedications on parcel maps.
In the absence of the above persons, the Senior Civil Engineer
may act in their place. This Resolution supercedes Resolution No.
84-085.

NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
authorize the Public Works Director, City Engineer, or Senior Civil Engineer, if such
persons were registered as a civil engineer prior to January 1, 1982, pursuant to the
Professional Engineers' Act (Chapter 7 of Division 3 of the Business and Professions
Code), to execute subdivision and parcel maps and accept dedications on parcel maps
on behalf of the City of Lodi; and
BE IT FURTHER RESOLVED that this Resolution supercedes Resolution
No. 94-26.
