MEETING DATE: April 15,2009 PREPAf' "D BY: Nancy Martinez, Library Services Director AECOIAMENDED ACTION: Adapt Resolution auffmizing the City Managerto execute the First Amendment to lie LeaseAgreement between Beckman Capital Corporation and the City of Lodi for the temporary location of the Lodi Public Library during construction. BACKGROUND INFORMATION: No City funding will be used to extend this lease. During the library renovation project the City has leased the Beckman Building located at 212 W. Pine Street from Beckman Capital Corporationfor a temporary library facility. The lease provides for an extension option at the same terms for up to a four month period. In extending the library renovation project to include the children's area, the library needs to remain in temporary quartetsfor an additional four months. The cost of the lease extension is funded totally by donated moneys. The terms of the amendment extend the lease from April 1,2009- July 31,2009. Pine Street Lodi, California THIS FIRST AMENDMENT TO LEASE entered into as of this _ day of , 2009, by BECKMAN CAPITAL CORPORATION ("Landlord") and THE CITY OF LODI, ("Tenant'). BACKGROUND A. Landlord and Tenant entered into a lease dated November 19, 2008 for the property located at 211 West Oak Street and 212 West Pine Street, Lodi ("Owned Premises"). B. Tenant desires to extend the lease for additional four months. C. Accordingly, the parties are entering into this first Amendment to Lease on the terms and conditions set forth below. AGREEMENT In consideration of their mutual covenants, the Parties agree to amend paragraph 3 of the Lease as follows: 3. Term. The term of this Lease shall be from December 1, 2008 ("Commencement Date") through to July 31, 2009, unless otherwise terminated as provided in this Lease. Tenant shall have the right to extend this Lease for four (4) one- month increments on thirty (30) days written notice to Landlord on the same terms as set forth herein. All other terms and conditions of the lease shall remain unchanged. STEPHEN SCHWABAUER RESOLUTION NO. 2009-43 A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE CITY MANAGER TO EXECUTE FIRST AMENDMENT TO LEASE AGREEMENT FOR TEMPORARY LIBRARY FACILITIES AT 212 WEST PINE STREET WHEREAS, the City of Lodi leased the Beckman Building located at 212 West Pine Street from Beckman Capital Corporation for a temporary library facility; and WHEREAS, the lease provides for an extension option at the same terms for up to a four-month period; and WHEREAS, the extension of the library renovation project to include the children's area requires that the library remain in temporary quarters up to an additional four months from April 1, 2009 through July 31, 2009. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize the City Manager to execute First Amendment to the Lease Agreement between Beckman Capital Corporation and the City of Lodi, extending the term of the lease through July 31, 2009, for the temporary location of the Lodi Public Library during the renovation project.
