SELECTION OF CITY MEMBERS TO THE SX9 JOAQUIN
VALLEY UNIFIED AIR POLLUTION CONTROL BOARD

AB 124 provides that the 62 cities in the South San Joaquin
District and the Central Valley District of the League of
California Cities may have three representatives on the San Joaquin
Valley Unified Air Pollution Control Board District (STMkPG'SD),
It also provides that the eight county area must have at least
three area designations by region known as the North, Central and
Sotth regions. It further states that the cities within the eight
county area must select the three representatives and that one
representative ha's to come from a city with a population less than
20,000; one from a City with a population of more than 50,000; and
from a City vith a population of between 20,000 to 50,000.
The eight county area primarily contains the entire areas of San
Joaquin, Stanislaus. Merced, Madera, King, Kern, Fresno and Tulare
Counties.
0m January 10, 1992, the Executive Boards of each League of
California Cities' District were invited to attend a meeting in
Merced. At thut meeting, a seleetian praeasg Uld adeptAd by tha
Executive Boards of each District. A dra,,e i n,3 was conducted to
decide what region would be represented by what. size city. The
Northern Region, subject to ratification by the general membership
of each division, oas designated as San Joaquin and Stanislaus
counties. By drawing, this region was chosen to be represented by
a mediu— size city for the first term.

0 RIVERBANK There are four medium size cities in the Northern region. They are
Manteca, Tracy, Ceres and Turlock. At the Central Valley Division
• SONORA Executive Board meeting in Stockton on January 3, 1992, it was
voted to desiqnate Blair Bradley of Ceres as the ;nedium size city
STOCK TON representative. Howexler, it is intended to ratify this at the
general membership meeting in Hughson on January 30th.

It is planned to conduct an election as well, one vote for erect,
city in attendance, on January 30th_ It is recognized that cities
will be in attendance from Merced County and perhaps, Madera
county. These cities, tentatively at this time, will not be in the
Northern Region if the action taken at the joint meeting of both
District's Executive Boards is ratified. The cities from these
counties will be in the Central Region. The cities of Sonora and
Angels Camp are currently not in the SJVUAPCD, therefore, they vill
be the only cities to be excluded from the meeting.
Ballots will be handed out at the Hughson meeting. In addition, a
full review and explanation of the legislation and selection
process vill be provided. In addition, an alternate mINItsi will be
elected. This member must come from a medium size city from within
the district.
I am encouraging all cities in the Central Valley District to be in
attendance ac the Xadera meeting to participate in this extremely
important selection process.

CALL TO ORDER
The meeting was called to order by Bob Hansen, President of the
South San Joaquin Valley Division, at 8:15 P.M. at Chiantis
Restaurant in Mercel, California.
BUSINESS ITEMS
President Hansen distributed copies of and explained the
suggested procedure and structure for Cities' representation on
the San Joaquin Valley Unified Air Pollution Control District.

i'res,dent Hansen also reported on a letter received from Doug
vagi,n, Chairman of the San Joacuan Val ley Unified Air Pollution
Control -District, statins in part, "Cities wiil need to develop
and enter into an agreement with the Unified District that spells
out the selection process, terms of city members and rotation
between regions for the small medium and large cities."
President Hansen note3 a letter has been prepared in response to
Mr. Vacim' s letter stating that the legislation does not provide
for the approval of the selection process by the Air Pollution
Contrci District nor does it require an agreeaent between the
cities and the District which outlines the process and that as
soon as the City appointees are named. the Valley Air Pollution
Control District will be notified.
It was the consensus of those present t`iat this letter be sent.
ACTION ON TAE PROPOSED PROCEDURE AND STRUCTURE
Section I - Regions
Motion by Larry Wilder (Reedley) , seconded by Tom Stearns
(Clovis) , a -.-id carried unanimously; to adopt regions as submitted:
North Central South
San Joaquin Fresno Kern
Stanislaus Madera Kings
Merced Tulare
Section lI - Term
it was dete-mined, after some discussion, that staggered terns
would not be possible because of having to rotate the size cities
in the reqions. Following the discussion, motion made by Richard
McBride (Ceres) , seconded by Mary Louise Vivier (Visalia) , and
carried unanimously, to approve Section II: Three year terms
commencing l/l/92 and every three years thereafter.
Section III - Unexpired Term
Motion made by Frank Warren (Manteca) , seconded by Bennie Gatto
(Lathrop) , and carried unanimously, to approve Section III: In
the event of a vacancy for whatever reason, the respective Region
w i i 1 appoint within 30 days a replacement member for the
remainder of the term.
Section IV - Attendance
Motion made by Frank Warren (,Aanteca) , seconded by Janet Carlsen
(Newman) , and carried unanimously, to approve Section VI: If any
member misses more than three scheduled meetings in a 12 -month
period, the cffice shall immediately be declared vacant and the
replacement steal; be sYlecte; by the respective Regio: w,th:n 30
days.
Section V- Removal f rom
There was some discussion regarding assurances that proper
notification would be given regarding meetings. Following
discussion, motion made by Ray Fudge (Dinuba), seconded by Mary
Louise Vivier W isalia), and carried unanimously, to approve
Section V: Any member. by Region, may to replaced by lie Reqion
if two-thirds (2/3) of the member cities present vote to declare
the office vacant.
Section VI - Population Changas
Motion made by Larry wider (Reedley), seconded. by BL -'1 Phillips
(Oakdale), and carried unanimously, tc approve Section Vl:
Member cities for all Reqions w i I I be placed in the appropriate
population category as of January I, 1992, and be changed each
three years thereafter.
Section VII - Rotation by Reaion Each Three Years
Motion made by Mary Louise Vivier (Visaiia), seconded by Richard
McBride (Ceres), and csrried unanimously. tc approve Section VII:
The rotation of regions after being initially designate2 by the
cities within the district shall be from south to north unless
changed by a two-thirds 12131 ma for i ty .
Section VIII - Region Designation
motion made by Bennie Gatto (Lar_hrop) , seconded by Mary Louise
Vivier W isalia), and carried unanimously. to approve Section
VIII: A simple majority of the cities present at the first
meeting to elect t�.e City representatives to the District shall
designate what Region will be regresanted for the first three-
year term beginning January 1., 1992, by a Iarqe city, by a medium
size city, and by a small city. This designation shall change on
the anniversary date of each three-year term.
Section IX - Nominatina Process
There was discussion as to whether the Joint Executive Board
wished to submit a slate of nominees to the Joint General
Membership for consideration. It was noted that in addition to
the slate, nominations would be taken from the floor at the
General Membership meeting.
Pat O'Rourke (Madera) expressed his feeling that it is important
that the Board make a recommendation. He stated the importance
of these positions make it imperative thzt the best possible
selection is made --it must be someone knowledgeable on this issue

It was the consensus cf those present that the _Executive Board

Section X - Votina Procedures
Motion made by Janet Car.sen (Newman) , seconded by Pat O'Rourke
(Madera) , and carried unanimously, to approve Section X. For the
purpose of establishing City representation on the SJWAPCD, each
City within a Region shall appoint an official representative who
shall have full authority to cast votes on behalf of the City.
Election of the first Czty representative shall be conducted at a
joint meeting of ail cities within the District.
Section XI - Alternate 'Member
It was determined through discussion that the alternate would be
able tc vote and that the alternate must be from the same region
and the same size city as the representative.
Motion made by Frank Warren (Manteca) , seconded by Richard
McBride (Ceres) , and carried unanimously, to approve Section XI:
Each Region shall elecr. ari Alternate Member who shall attend
meetings of the District and act on behalf of the member when the
member is unable to attend.
Section XII - Eligibili~v
Mary Louise Vivier (Visalia) presented her thouqhts that the
representative not necessarily be currently an elected official.
She stated a former Council member from Visalia is eminently
qualified having served on the City Council for sixteen years and
having worked for the County, w_it?t experience ;.n Planning and
other areas that could be beneficial on this board. Her
suggestion was that past Council members also be eligible for
appointment to the Board.

city to the region by the drawing of lots. The words small,
medi= and larae were placed on pieces 'of paper --d placed in a
basket. The draw for the North Reuion was for ; edium size
city, the draw for the Central Region was for a large size city
and the draw for the South Region was for a small size city.
It was determined that the vote at the Generai Memzership meeting
when appointing the representatives should be by the entire
General Membership. not regionally.
CLOSING C NA4E *,TM
Terry Dugan of the League of California Cities made some comments
re—emphasizinq the importance of making the right selections for
this Board and the importance of riving a lot of support to these
representatives.
President Hansen stated he and ..oralee McGau_,ney would set up a
nominating committee.
It was the consensus of those present that a joint General
Membership meeting be scheduled for February 1 4 , 1992, in Madera
at the Madera Municipal Golf Course at which time the
zppointments ro the San Joaquin Valley Unified Air Po? lutior:
Control District will be made.
ADJOURNMENT 9:55 P.M.
Following adjournment, Loralee McGaughey, President of the
Central valley Division and Bob Hansen, President of the South
San Joaquin Valley Division made the following appointments to
the Nominatinq Committee: Frank Muratore (Modesto) , ?at O'Rourke
(Hadera), Mary Louise Vivier (Visalia) , Loralee McGaughey
(Stockton) and Bob Hansen (Corcoran) .

Divisions of the League of California Cities shall solicit
nominations for City officials interested ir: serving on the
SJWAPCD from all cities within the District. The pre idents of
the t,,o League Divisions, in consultation with 1-e Division
Executive Committees, shall appoint a nominating committee to
recommend to a neeting of cities throuchou. the District three
city representatives to serve o:. the S:: IJAPCI_'' .
Section X - Voting Procedures

SJWAPCD, each City within a Region shall appoint a, official
