AGENDA TITLE: Adopt Resolution Accepting Improvements at 495 North Guild Avenue

RECOMMENDED ACTION: Adopt a resolution accepting improvements at 495 North Guild Avenue
BACKGROUND INFORMATION: Improvementsat 495 North Guild Avenue have been completed in
substantial conformancewith the requirements of the improvement
agreement between the City of Lodi and Kenneth W. Bowers,
Delmar D. Batch and Doris Batch, as approved by the City Council
on June 21, 2006, amended by City Council on July 18,2007, and as shown on Drawings No. 006DO03-01
through 006D003-05.
Project improvements included the installation of a master plan water main in the easement west of
Guild Avenue, as well as street pavement improvements, curb, gutter and sidewalk, hydrants and street
lights on Guild Avenue. The addendum to the improvement agreement provided the developer with an
additional year to complete the improvements.
The streets to be accepted are as follows:

w The street dedication for Guild Avenue widens an existing street. This street dedication did not
add additional miles to the City's street system.
This development is a portion of the Lodi Consolidated Landscape and Maintenance District No. 2003-01
FISCAL IMPACT: Per Item 17, "Repair or Reconstruction of Defective Work", of the
improvement agreement, the developer's warranty period of one year will
begin on the date of Council acceptance. There will be a slight increase in
long-term maintenance costs for public infrastructure, such as streets,
water, wastewater and storm drain facilities, and City services, such as police and fire. The maintenance
and replacement costs for a future traffic signal at Guild Avenue and Victor Road and the expected
increases in park maintenance costs will be funded through the Lodi Consolidated Landscape and
Maintenance District No. 2003-01.

A RESOLUTION OF THE LODI CITY COUNCIL ACCEPTING
IMPROVEMENTSAT 495 NORTH GUILD AVENUE INCLUDED
IN THE IMPROVEMENTAGREEMENT BETWEEN THE CITY OF
LODI AND KENNETH W. BOWERS, DELMAR D. BATCH,
AND DORIS BATCH
The City Council of the City of Lodi finds:
1. That all requirements of the Improvement Agreement and Improvement
Agreement Amendment between the City of Lodi and Kenneth W. Bowers,
Delmar D. Batch, and Doris Batch have been substantially complied with. The
improvements are shown on Drawing Nos. 006D003-01 through 006D003-05 on file in
the Public Works Department and as specifically set forth in the plans and specifications
approved by the City Council on June 21, 2006, and amended by the City Council on
July 18, 2007.
2. The streets to be accepted are as follows:

improvements in the subject project. A copy of the resolution is enclosed for your files.
This letter is your authorization to exonerate the Instrumentof Credit covering faithful
performance, The Instrumentof Credit covering laborand materials must remain in
effect until July 1, 2008, in conformance with State law. You will receive no further
correspondence regarding the release of the Instrument of Credit.

The City Council of the City of Lodi, at its meeting on April 2, 2008, accepted the public
improvements that were made in the subject project.
Enclosed for your files is a copy of the resolution accepting the public improvements.
From the date of the resolution, the City of Lodi will maintain the street and other public
improvements installed within rights-of-way and public utility easements as shown on the
approved plans.
The enclosed letter has been sent to your bank so the Instrumentof Credit covering
faithful performance can be exonerated. The Instrument of Credit covering labor and
materials must remain in effect for a period of ninety days from the date of the
resolution, in conformance with State law. On July 1, 2008, this instrument can be
released if no claims have been filed.
