BACKOROOND INFORMATION: As part of the City's Lower Sacramento Road (Kettleman Lane to Harney Lane) project and the County's Harney Curve project, more than $902,905 in public improvements were constructed that benefit the adjacent parcels and would be required to be installed at the time of development of those parcels. To recover those costs, staff recommends formation of an Area of Benefit pursuant to Lodi Municipal Code 16.40.030. The boundary of the Area of Benefit is presented in Exhibit A. The improvements installed at City expense for the benefit of future development are described by parcel in Exhibit B. Generally, the improvements include water, sewer, storm drain, traffic signal, and dry utility conduits that are not required for the roadway project but were installed to avoid trenching in the new roadway in the future. Calculation of the reimbursable costs is presented in Exhibit C. The calculation is based upon the contract quantities and unit prices from the two separate projects. Staff recommends the reimbursable costs be combined into the groupings shown in Exhibit A to reflect the expected flow of development applications. The total reimbursement to the City is calculated to be $902,905. Payment of reimbursement costs will be a condition of approval for any future applications for entitlements, including development plans, development agreements, tentative subdivision maps, lot line adjustments, and final maps for the benefiting parcel groups. The payment would be collected at the time of City Council approval of a subdivision map within each group and the amount collected would be prorated based upon the area of the map. The groups and the total reimbursement (rounded) for each group is listed below (note the parcels on Harney Lane east of Lower Sacramento Road are not grouped, hence the sum of the figures below do not equal the above total). 1. Pursuant to LMC Section 15.64.080, the reimbursable amount will be adjusted annually to include an amount attributable to interest, which will be based on the change in the Engineering News Record (ENR) 20 Cities Construction Cost Index from January 1, 2006 to January 1st of the year of reimbursement. The beginning ENR index is 7660. In conformance with LMC 16.40, staff recommends that Council conduct a public hearing to establish an Area of Benefit and Reimbursable Costs to recover the cost of improvements constructed with the Lower Sacramento Road (Kattleman Lane to Harney Lane) project that benefit adjacent properties. Three contracts were awarded, two by the City of Lodi and one by San Joaquin County. They consisted of the Lower Sacramento Road Widening Project (City), Century Boulevard Construct Project (City) and the Harney Curve Project (County). The Harney Lane work consisted of removing the old County roadway and reconstructing a new wider roadway in the approximate same horizontal and vertical location. Right of way was obtained from the adjacent landowners that would accommodate the full future widening of the roadway. Dedication of the rights of way was generally traded for the roadway improvements. Storm drainage facilities were installed to convey runoff from the new roadway to the adjacent storm drainage basin. Existing overhead PG&E distribution lines, ATT phone lines, and Comcast cable lines were relocated to the ultimate future location as allowed by the right of way dedications. At the time the planning and design studies took place, there was no evidence that development of the adjacent vacant parcels would occur any time in the near future. At the time of construction, the City was processing applications for development. Recognizing the City's preference not to open trench across new streets and the cost savings of constructing utilities crossing the roadway during a full closure condition, it was determined that many of the future utilities required to serve the new development could and should be installed concurrently with the construction of the roadway improvements. The following provides a property -specific description of the facilities constructed and the cost share methodology for determining the fair share costs assignment to the property. Lodi Shopping Center Site 1: BDC Lodi III/APN 058-030-13 8 -inch Sanitary Sewer Service: 54 feet of pipe was constructed at an existing manhole providing for a future sanitary sewer service to the site. Another 38 feet of pipe was constructed and a manhole installed for the connection to provide for a future sanitary sewer connection to the site. Costs for the pipe and one-half of the manhole is allocated to the site at a price of $18,570. 10 -inch Water Main: 496 feet of pipe was constructed along the frontage of the site. Half of the cost or 248 feet is allocated to this site for a cost of $12,152. 10 -inch Water Valve and Service Stub: Two 10 -inch service stubs with a valve at the main were installed along with -86 and 105 feet of 10 -inch water pipe extended to the site. The total cost was $13,789. Lodi Electric Utility Conduit Crossing: A gang of (1) 2 -inch conduit, (1) 4 -inch conduit, and (3) 6 -inch conduits was installed across the street (101.5 feet) at the southerly driveway for future underground phone, television and electrical power to the site. One half of the cost is allocated to the site at a price of $4,573. K:\WP\DEV SERV\CCSetPHAreaofBenefitLwrSac ExB revised.doc I Future Traffic Signal Conduit: One conduit each of size 2 -inch and 4 -inch were installed the 100 feet across the street. The full cost of $2,390 is allocated to the site. Design Changes to accommodate the future Lodi Shopping Center Driveway with turn pockets and the traffic signal were completed by Mark Thomas and Company. One-third of the cost is allocated to the site at a price of $18,150. Interim Safety and Traffic Control: In order to prohibit traffic from using the left -turn pockets at the future driveway location, K -rail and delineators were installed at a cost of $4,692. With ten percent added for Engineering and Administration, the total reimbursable cost is $81,748. Southwest Gateway Group Site 2: Van Ruiten/APN 058-030-03 Industrial Waste (30 -inch) Realignment: The manhole and stub (27 feet) required for the realignment of the Industrial Waste Trunkline at the north side of the site is required for the new development. The cost of these facilities is $7,810. Domestic Waste (21 -inch) Realignment: The manhole and stub (38 feet) required for the realignment of the Domestic Waste Trunkline at the north side of the site is required for the new development. The cost of these facilities is $12,030. Domestic Waste (42 -inch) Realignment. The pipe segment at Century Boulevard across Lower Sacramento Road is required for the realignment that is driven by the new development. The cost of the 218 feet of pipe is $85,020. Storm Drainage Outfall (I -Basin to G-Basin/Outfall): The 48 -inch pipe segment at Century Boulevard across Lower Sacramento Road is the outfall line from I -Basin to the WID Terminal Drainage. The cost of the 242 feet of pipe is $49,610. 10 -inch Water Main: The combined frontage width is 492 feet and 492 feet of water pipe was constructed along the frontage of the site. Half of the cost or 246 feet is allocated to this site for a cost of $12,054. 10 -inch Water Valve and Service Stub: Two 10 -inch service stubs with a valve at the main were installed along with 74 and 131 feet of 10 -inch water pipe extended to the site. The total cost was $14,475. Lodi Electric Utility Conduit Crossing: At the south side of Century Boulevard, a 132 -foot conduit crossing of Lower Sacramento Road was constructed with (2) 2 -inch conduits, (2) 4 -inch conduits, and (2) 6 -inch conduits. Half of the cost of this crossing was assigned to Site 2. In addition, an 86 -foot conduit crossing of Century Boulevard on the west side of Lower Sacramento Road was constructed with (1) 2 -inch conduit, (2) 4 -inch conduits, and (2) 6 -inch conduits. The cost of this crossing was assigned to Site 2. The total cost for the two conduit crossings is $13,730.20. 48 -inch Storm Drain (Century Boulevard): The storm drain outlet piping for I -Basin was constructed in the correct location with the Lower Sacramento Road and Century Boulevard K:\WP\DEV SERV\CCSetPHAreaofBenefitLwrSac ExB revised.doc 2 projects. The total length of pipe was 447 feet and Site 2 was assigned half of the cost. The cost of this piping was $86,817.50. Traffic Signal at Century Boulevard: The traffic signal at this location was assigned one-quarter to each of the adjoining large parcel sites. The cost of the traffic signal attributed to Site 2 is $38,325.00. With ten percent added for Engineering and Administration, the total reimbursable cost is $351,281. Site 3: Van Ruiten/APN 058-030-04 10 -inch Water Main: The combined frontage width is 90 feet and 90 feet of water pipe was constructed along the frontage of the site. Half of the cost or 45 feet is allocated to this site for a cost of $4,410. Lodi Electric Utility Conduit Crossing: A 97 -foot conduit crossing of Lower Sacramento Road was constructed with (3) 2 -inch conduits and (2) 4 -inch conduits for future underground phone, television and electrical power to the site. One half of the cost is allocated to Site 3 and one half to Site 21 at a price of $4,910 each. With ten percent added for Engineering and Administration, the total reimbursable cost is $10,252. Site 4: Van Ruiten/APN 058-030-05 10 -inch Water Main: The frontage width is 660 feet and 660 feet of water pipe was constructed along the frontage of the site. Half of the cost or 330 feet is allocated to this site for a cost of $16,170. Water Valves and Service Stubs: One 6 -inch service stub with a 6 -inch valve at the main was installed along with 70 feet of 6 -inch water pipe extended to the site. One 10 -inch service stub with a 10 -inch valve at the main and 74 feet of 10 -inch pipe were installed. The total cost was $9,993.50. With ten percent added for Engineering and Administration, the total reimbursable cost is $27,562. Site 6: Schumacher/APN 058-040-01 10 -inch Water Valve and Service Stub: One 10 -inch service stub with a valve at the main was installed along with a 68 feet of 10 -inch water pipe extended to the site. The total cost was $5,547. Lodi Electric Utility Conduit Crossing: A 107 -foot conduit crossing of Lower Sacramento Road was constructed with (2) 2 -inch conduits and (1) 4 -inch conduit for future underground phone, television and electrical power to the site. One half of the cost is allocated to Site 6 and one half to the park site at a price of $3,309 each. The cost of the traffic signal attributed to Site 2 is $38,325. With ten percent added for Engineering and Administration, the total reimbursable cost is $147,398. Site 7: Schumacher/APN 058-040-02 10 -inch Water Valve and Service Stub: One 10 -inch service stub with a valve at the main was installed along with 72 feet of 10 -inch water pipe extended to the site. The total cost was $5,743. Lodi Electric Utility Conduit Crossing: A 124 -foot conduit crossing of Lower Sacramento Road was constructed with (2) 2 -inch conduits and (1) 4 -inch conduit for future underground phone, television and electrical power to the site. One half of the cost is allocated to Site 7 and one half to the Vintage Oaks subdivision at a price of $3,844 each. With ten percent added for Engineering and Administration, the total reimbursable cost is $10,546. Site 8: Schumacher/APN 058-040-04 10 -inch Water Main: The frontage width is 317 feet and 317 feet of 10 -inch water pipe was constructed along the frontage of the site. Half of the cost or 158 feet and half of the cost of the inline 10 -inch valve is allocated to this site for a cost of $8,849.50. 8 -inch Water Valve and Service Stub: One 8 -inch service stub with a valve at the main was installed along with 62 feet of 8 -inch water pipe extended to the site. The total cost was $4,095. Lodi Electric Utility Conduit Crossing: A 119 -foot conduit crossing of Lower Sacramento Road was constructed with (2) 2 -inch conduits and (1) 4 -inch conduit for future underground phone, television and electrical power to the site. One half of the cost is allocated to Site 8 and one half to the City at a price of $3,697 each. With ten percent added for Engineering and Administration, the total reimbursable cost is $18,306. Site 9: Schumacher/APN 058-040-05 10 -inch Water Main (City Project): The frontage width is 167 feet and 167 feet of 10 -inch water pipe was constructed along the frontage of the site. Half of the cost or 84 feet and half of the cost of the inline 10 -inch valve is allocated to this site for a cost of $5,223.50. 10 -inch Water Main (County Project): Water main was installed on Lower Sacramento Road and Harney Lane in lengths of 326 feet and 66 feet, respectively. Half of the cost or 163 feet and 33 feet and half of the cost of the inline 10 -inch valve is allocated to this site for a cost of $15,337. Lodi Electric Utility Conduit Crossing: One crossing of Lower Sacramento Road [2 -inch (2), 4 -inch (1), 6 -inch (2)] and one crossing of Harney Lane [2 -inch (2), 4 -inch (1), 6 -inch (1)] were installed. Half of the cost of each is allocated to this site for a cost of $7,312. Traffic Signal at Century Boulevard: The traffic signal at this location was assigned one-quarter to each of the adjoining large parcel sites. The cost of the traffic signal attributed to Site 23 is $38,325. Lodi Electric Utility Conduit Crossing: A 150 -foot conduit crossing of Century Boulevard was constructed with (1) 2 -inch conduit, (1) 4 -inch conduit and (3) 6 -inch conduits for future underground phone, television and electrical power to the site. The whole cost is allocated to Site 23 at a price of $11,550. With ten percent added for Engineering and Administration, the total reimbursable cost is $72,811. Site 22: Peterson/APN 058-140-14 10 -inch Water Main: The frontage width is 84 feet and 84 feet of water pipe was constructed along the frontage of the site. Half of the cost or 42 feet is allocated to this site for a cost of $2,058. Lodi Electric Utility Conduit Crossing: A 101.5 -foot conduit crossing of Lower Sacramento Road was constructed with (1) 2 -inch conduits, (1) 4 -inch conduit and (3) 6 -inch conduits for future underground phone, television and electrical power to the site. One half of the cost is allocated to Site 1 and one half to Site 22 at a price of $4,573 each. With ten percent added for Engineering and Administration, the total reimbursable cost is 7,294. Site 21: Peterson/APN 058-140-12 10 -inch Water Main: The frontage width is 662 feet and 662 feet of water pipe was constructed along the frontage of the site. Half of the cost or 331 feet is allocated to this site for a cost of $16,219. Water Valves and Service Stubs: One 6 -inch service stub with a 6 -inch valve at the main was installed along with 16 feet of water pipe extended to the site. One 10 -inch service stub consisting of 15 feet of 10 -inch pipe was installed. The total cost was $6,257. Lodi Electric Utility Conduit Crossing: A 97 -foot conduit crossing of Lower Sacramento Road was constructed with (3) 2 -inch conduits and (2) 4 -inch conduits for future underground phone, television and electrical power to the site. One half of the cost is allocated to Site 3 and one half to Site 21 at a price of $4,910 each. With ten percent added for Engineering and Administration, the total reimbursable cost is 28,292. The total acreage of the area is 6.13 acres. 10 -inch Water Main: The frontage width is 778 feet and 778 feet of water pipe was constructed along the frontage of the site. Half of the cost or 389 feet is allocated to this site for a cost of $19,061. 8 -inch Water Valve and Service: 11 feet of pipe was constructed and a new valve installed to provide service to the site. The total cost was $2,310. 8 -inch Sanitary Sewer Service: 54 feet of pipe was constructed at a new manhole providing for a future sanitary sewer service to the site. A manhole was installed and half the cost was assigned to this site for a total of $11,540. 18 -inch Storm Drain Service: 31 feet of pipe was constructed at a new manhole providing for a future storm drain service to the site. A manhole was installed and the whole cost was assigned to this site because it was the only connection to the manhole. The total cost was $7,525. With ten percent added for Engineering and Administration, the total reimbursable cost is $44,480. Harney Lane (East of Lower Sacramento Road) Site 10: Havn/APN 058-070-07 10 -inch Water Main: The frontage width is 206 feet and 206 feet of water pipe was constructed along the frontage of the site. Half of the cost or 103 feet is allocated to this site for a cost of $7,416. With ten percent added for Engineering and Administration, the total reimbursable cost is $8,158. Site 11 Bell/APN 058-070-08 10 -inch Water Main: The frontage width is 206 feet and 206 feet of water pipe was constructed along the frontage of the site. Half of the cost or 103 feet is allocated to this site for a cost of $7,416. With ten percent added for Engineering and Administration, the total reimbursable cost is $8,158. Site 12 Woods/APN 058-070-09 10 -inch Water Main: The frontage width is 206 feet and 206 feet of water pipe was constructed along the frontage of the site. Half of the cost or 163 feet and 190 feet and half of the cost of the inline 10 -inch valve is allocated to this site for a cost of $26,641. Lodi Electric Utility Conduit Crossing: One crossing of Lower Sacramento Road [2 -inch (2), 4 -inch (1), 6 -inch (2)] and one crossing of Harney Lane [2 -inch (2), 4 -inch (1), 6 -inch (1)] were installed. pert of the City's Lower Sacramento Road (Kettleman Lane to Harney Lane) project and San Joaquin County's Harney Cure project, more than $902,905 in public improvements were constructed that benefit the adjacent parcels and would be required to be installed at the time of development of those parcels. To recover those costs, staff recommends formation of an Area of Benefit pursuant to Lodi Municipal Code (LMC) §16.40.030, as shown on Exhibit A and Exhibit B attached; and WHEREAS, generally, the improvements included the installation of water, sewer, storm drain, traffic signal, and dry utility conduits that are not required for the roadway project, but were installed to avoid trenching in the new roadway in the future; and WHEREAS, pursuant to LMC Section 16.40.030, the costs of improvements installed by the City that benefit adjacent properties and would be required of the properties upon development are reimbursable to the City, as shown in Exhibit C attached. NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that: a) The City Council hereby establishes an Area of Benefit as shown on Exhibit A. b) A summary by category of reimbursable improvements for each parcel is provided in Exhibit B. This exhibit also provides an explanation of how the benefit was determined for each category. C) The reimbursable costs for each of the benefiting properties have been calculated and are shown in Exhibit C. The total reimbursement to the City is calculated to be $902,905. d) Payment of reimbursement costs will be a condition of approval for any future complete applications for entitlements, including development plans, development agreements, tentative subdivision maps, lot line adjustments, and final maps for the benefiting parcel groups. For payment collection purposes, some of the benefiting parcels have been segregated into the following groups as shown on Exhibit B: 1. Lodi Shopping Center $ 81,748 2. Olve Drive Group $ 44,480 3. Three contracts were awarded, two by the City of Lodi and one by San Joaquin County. They consisted of the Lower Sacramento Road Widening Project (City), Century Boulevard Construct Project (City) and the Marney Curve Project (County). The Harney Lane work consisted of removing the old County roadway and reconstructing a new wider roadway in the approximate same horizontal and vertical location. Right of way was obtained from the adjacent landowners that would accommodate the full future widening of the roadway. Dedication of the rights of way was generally traded for the roadway improvements. Storm drainage facilities were installed to convey runoff from the new roadway to the adjacent storm drainage basin. Existing overhead PG&E distribution lines, ATT phone lines, and Comcast cable lines were relocated to the ultimate future location as allowed by the right of way dedications. At the time the planning and design studies took place, there was no evidence that development of the adjacent vacant parcels would occur any time in the near future. At the time of construction, the City was processing applications for development. Recognizing the City's preference not to open trencb across new streets and the cost savings of constructing utilities crossing the roadway during a full closure condition, it was determined that many of the future utilities required to serve the new development could and should be installed concurrently with the construction of the roadway improvements. The following provides a property -specific description of the facilities constructed and the cost share methodology for determining the fair share costs assignment to the property. Lodi Slopping Center Site 1: BDC Lodi III/APN 058-030-13 9 -inch Sanitary Sewer Service: 54 feet of pipe was constructed at an existing manhole providing for a future sanitary sewer service to the site. Another 38 feet of pipe was constructed and a manhole installed for the connection to provide for a future sanitary sewer connection to the site. Costs for the pipe and one-half of the manhole is allocated to the site at a price of $18,570. 10 -inch Water Main 496 feet of pipe was constructed along the frontage of the site. Half of the cost or 248 feet is allocated to this site for a cost of $12,152. I0 -inch Water Valve and Service Stub: Two 10 -inch service stubs with a valve at the main were installed along with -86 and 105 feet of 10 -inch water pipe extended to the site. The total cost was $13,789. Lodi Electric Utility Conduit Crossing: A gang of (1) 2 -inch conduit, (1) 4 -inch conduit, and (3) 6 -inch conduits was installed across the street (101.5 feet) at the southerly driveway for future underground phone, television and electrical power to the site. One half of the cost is allocated to the site at a price of $4,573. The full cost of $2,390 is allocated to the site. Design Changes to accommodate the future Lodi Shopping Center Driveway with turn pockets and the traffic signal were completed by Mark Thomas and Company. One-third of the cost is allocated to the site at a price of $18,150. Interim Safety and Traffic Control: In order to prohibit traffic from using the left -turn pockets at the future driveway location, K -rail and delineators were installed at a cost of $4,692. With ten percent added for Engineering and Administration, the total reimbursable cost is $81,748. Southwest Gateway Group Site 2: Van Ruiten/APN 058-030-03 Industrial Waste (30 -inch) Realignment: The manhole and stub (27 feet) required for the realignment of the Industrial Waste Trunkline at the north side of the site is required for the new development. The coat of these facilities is $7,810. Domestic Waste (21 -inch) Realignment: The manhole and stub (38 feet) required for the realignment of the Domestic Waste Trunkline at the north side of the site is required for the new development. The coat of these facilities is $12,030. Domestic Waste (42 -inch) Realignment. The pipe segment at Century Boulevard across Lower Sacramento Road is required for the realignment that is driven by the new developrawt. The cost of the 218 feet of pipe is $85,020. Storm Drainage Outfall (I -Basin to G-Basin/Outfall): The 48 -inch pipe segment at Century Boulevard across Lower Sacramento Road is the outfall line from I -Basin to the WID Terminal Drainage. The cost of the 242 feet of pipe is $49,610. I0 -inch Water Main: The combined frontage width is 492 feet and 492 feet of water pipe was constructed along the frontage of the site. Half of the cost or 246 feet is allocated to this site for a cost of $12,054. 10 -inch Water Valve and Service Stub: Two 10 -inch service stubs with a valve at the main were installed along with 74 and 131 feet of I0 -inch water pipe extended to the site. The total cost was $14,475. Lodi Electric Utility Conduit Crossing: At the south side of Century Boulevard, a 132 -foot conduit crossing of Lower Sacramento Road was constructed with (2) 2 -inch conduits, (2) 4 -inch conduits, and (2) 6 -inch conduits. Half of the cost of this crossing was assigned to Site 2. In addition, an 86 -foot conduit crossing of Century Boulevard on the west side of Lower Sacramento Road was constructed with (1) 2 -inch conduit, (2) 4 -inch conduits, and (2) 6 -inch conduits. The cost of this crossing was assigned to Site 2. The total cost for the two conduit crossings is $13,730.20. 48 -inch Storm Drain (Century Boulevard): The storm drain outlet piping for I -Basin was constructed in the correct location with the Lower Sacramento Road and Century Boulevard K:\WP\DEV_SERV\CCSetPHArewfBenefitLwrSac_ExB_yeviwd.doc 2 projects. The total length of pipe was 447 feet and Site 2 was assigned half of the cost. The cost of this piping was $86;817.50. Traffic Signal at Century Boulevard: The traffic signal at this location was assigned one-quarter to each of the adjoining large parcel sites. The cost of the traffic signal attributed to Site 2 is $38,325.00. With ten percent added for Engineering and Administration, the total reimbursable cost is $351,281. Site 3: Van Ruiten/AtN 058-030-04 10 -inch Water Main: The combined frontage width is 90 feet and 90 feet of water pipe was constructed along the frontage of the site. Half of the cost or 45 feet is allocated to this site for a cost of $4,410. Lodi Electric Utility Conduit Crossing: A 97 -foot conduit crossing of Lower Sacramento Road was constructed with (3) 2 -inch conduits and (2) 4 -inch conduits for future underground phone, television and electrical power to the site. One half of the cost is allocated to Site 3 and one half to Site 21 at a price of $4,910 each. With ten percent added for Engineering and Administration, the total reimbursable cost is $10,252. Back in19*5 we tried to get city services , but we were told it wasn't possible at that time but when the Taves property carne into the city limits we also would be included that didn't happen. Since that time we have spent thousands of dollars upgrading our septic systems and wells. therefore your so called benefits aren't of benefit to us. We have had two letters and the price has doubled between the first and second letter from city of Lodi.
