RECOMINENEiED ACTION: Accept the improvements under the "Municipal Service Center (MSC)
Additional Compressed Natural Gas (CNG) Installation Project" contract.
BACKGROUND INFORMATION: The project was awarded to Performance Mechanical, Inc., of Pittsburg,
CA, on August 2, 2006, in the amount of $44,602. The contract has been
completed in substantial conformance with the plans and specifications
approved by City Council.
This project consisted of the installation of additional Compressed Natural Gas (CNG) fueling equipment within the
existing fueling facility at the Murilcipal Service Center (MSC). The City previously constructed a CNG fueling
facility at the MSC to accommodate transit vehicles and miscellaneous CNG -fueled City equipment. This project
installed a second compressor at the MSC, allowing for additional fueling capacity for an expanding transit fleet, as
well as backup so that the compressors can be serviced without disrupting the fueling capabilities of the City fleet.
The contract completion date was originally November 1, 2006, but was extended to November 22, 2006. The
actual completion date was December 12, 2006, due to some additional work on the City's part. The final contract
price was $65,004. The difference between the contract amount and the final contract price is due to three contract
change orders at $20,402, which consisted of the following; additional valves and fittings were required by the
Engineer to install a beacon light on an existing control panel, re -work of some conduit, installation of new stainless
steel tubing to nine slow -fill stations to replace existing supply piping, and the installation of one sacrificial anode.
The majority of this work and expense was needed to correct deficiencies with the cathodic protection system
installed by the City's former contractor at the time the CNG station was originally constructed. The City is in
litigation with this former contractor.
Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of Completion with
the County Recorder's office. The notice serves to notify vendors and subcontractors that the project is complete
and begins their 30 -day period to file a stop notice requiring the City to withhold payments from the prime contractor
in the event of a payment dispute.
FISCAL IMPACT: Funds for the project were budgeted in a capital project account and drawn from
the Transit Facilities Upgrade Account. Operating expenses for the additional
fueling compressor should be minimal, as only one compressor operates at a time.
