MEETING DATE: PREPARED BY: October 5, 2005 City Attorney RECOMMENDED ACTION: Discuss prospect of disabling City from engaging in Eminent Domain for purpose of sale to a private party and provide direction to Staff as appropriate. BACKGROUND INFORMATION: This item was placed on the agenda at the request of Mayor Beckman and Council Member Mounce. As Council is aware, the U.S. Supreme Court recently approved the use of eminent domain to acquire property that was not blighted with the intent of turning the property over to a private party to stimulate redevelopment of the surrounding area in the Kilo case. The federal and state legislatures are currently considering legislation to reverse the decision. A number of cities are considering similar ordinances. FISCAL IMPACT: None.
