RECOMMENDED ACTION: That the City Council conduct a public hearing to consider
Reimbursement Agreement RA -05-01 establishing an area of
benefit and reimbursable costs for public improvements for
Legacy Estates, Unit No. 1, Tract 3260.
BACKGROUND INFORMATION: The Legacy Estates, Unit No. 1, subdivision is located north of
Harney Lane, east of Lower Sacramento Road, and south of
DeBenedetti Park. The developer, FCB Building Partners II,
entered into an improvement agreementwith the City on
November 24, 2003. Terms of the improvement agreement required the installation of certain public
improvements, including the public sewer trunk line in Harney Lane, to serve the proposed subdivision
and other properties (Exhibit A, Site Nos. 9 through 39) inside the Harney Lane Lift Station Service Area
The public improvements also include the frontage improvements for 2139 West Harney Lane
(Site No. 14) on Legacy Way and Harney Lane and future water and sewer extensions benefiting the
properties northwest of the Legacy Estates, Unit No. 1 (Site Nos. 23, 24, and 25).
The developer has requested a reimbursementagreement and establishment of an area of benefit in
conformance with Chapter 16.40 of the Lodi Municipal Code (LMC) for those improvements that benefit
the neighboring properties.
The property owners within the area of benefit have been notified. The developer has paid the
appropriate application fee and the fees to cover the cost of recording the reimbursement agreement. A
copy of the itemized costs for the reimbursable improvements is attached as Exhibit B. The acreages
and site numbers used in the reimbursement calculation are consistentwith acreage and site numbers
established in the previously -adopted Area of Benefit for the Harney Lane Sewer Lift Station
Improvements (RA -03-04).
Pursuant to LMC 16.40, staff recommendsthat Council conduct a public hearing to establish an area of
benefit and reimbursable costs to recover the cost of public improvements benefiting the properties as
shown on Exhibit A. A summary of the reimbursable costs for the properties is presented in Exhibit C.
Pursuant to LMC §1 6.40.50.A.3, the reimbursable amount shall be recalculated annually to include an
amount attributable to interest, using the Engineer News Record (ENR) 20 Cities Construction Cost
index. Similar adjustments to the reimbursable costs will be made each January until payment is

received. In the event that the benefiting properties shown on ExhibitA develop, the City will collect the
appropriate amounts from the developers of the benefiting property and reimburse the developer. The
charges for a benefiting property shall be paid in full at the time of the first development on that property.
The reimbursement agreement expires 15 years after adoption.
In conformance with LMC 16.40, staff recommends that Council conduct a public hearing to establish an
area of benefit and reimbursable costs to recover the cost of public improvements from the benefiting
properties.
FISCAL IMPACT: None.
FUNDING AVAILABLE: Applicant fees and reimbursement fees collected from future development.

RESOLUTION NO. 2005-124
A RESOLUTION OF THE LODI CITY COUNCIL ESTABLISHING
AN AREA OF BENEFIT AND REIMBURSABLE COSTS FOR
LEGACY ESTATES, UNIT NO. 1, TRACT NO. 3260
WHEREAS, Legacy Estates, Unit No. 1, subdivision is located north of Harney Lane,
east of Lower Sacramento Road, and south of DeBenedetti Park; and
WHEREAS, the Developer, FCB Building Partners II, entered into an improvement
agreement with the City on November 24, 2003, which required the installation of certain public
improvements, including the public sewer trunk line in Harney Lane, to serve the proposed
subdivision and other properties (Exhibit A, Site Nos. 9 through 39) inside the Harney Lane Lift
Station Service Area. The public improvements also include the frontage improvements for
2139 West Harney Lane (Site No. 14) on Legacy Way and Harney Lane and future water and
sewer extensions benefiting the properties northwest of the Legacy Estates, Unit No. 1 (Site
Nos. 23, 24, and 25); and
WHEREAS, the developer has requested a reimbursement agreement and
establishment of an area of benefit in conformance with Chapter 16.40 of the Lodi Municipal
Code for those improvements that benefit the neighboring properties; and
WHEREAS, a copy of the itemized costs for the reimbursable improvements is attached
as ExhibitB; and
WHEREAS, the acreages and site numbers used in the reimbursement calculation are
consistent with acreage and site numbers established in the previously -adopted Area of Benefit
for the Harney Lane Sewer Lift Station Improvements (RA -03-04); and
WHEREAS, in conformance with Lodi Municipal Code Section 16.40, staff
recommended that the City Council conduct a public hearing to establish an area Cr benefit and
reimbursable costs to recover the costs for those improvements that benefit the neighboring
properties as shown on Exhibit C attached; and
WHEREAS, pursuant to Lodi Municipal Code Section 16.40.50.A.3, the reimbursable
amounts will be recalculated and adjusted annually in January to include an amount attributable
to interest. The -annual adjustment will be based on the change in the Engineering News
Record (ENR) 20: Cities Construction Cost Index from January 1 of the previous year. The
beginning ENR index will be 7308.
NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that:
a) The City Council hereby establishes an area of benefit and reimbursable costs to
recover the costs for those improvements that benefit the neighboring properties,
as shown on Exhibit A attached, and shall be collected at the time of
development for each parcel; and
b) Pursuant to Lodi Municipal Code Section 16.40.50.A.3, the reimbursable
amounts will be recalculated and adjusted annually in January to include an
amount attributable to interest, using the Engineering News Record (ENR) 20
Cities Construction Cost Index from January 1 of the previous year. The
beginning ENR index will be 7308.

NOTICE IS HEREBY GIVEN that on Wednesday, June 15, 2005, at the hour of 7:00 p.m., or as soon

RECOMMENDED ACTION: That the City Council set a Public Hearing for June 15, 2005, to
consider Reimbursement Agreement RA -05-01 establishing an area
of benefit and reimbursable costs for public improvements for
Legacy Estates, UnitNo.1, Tract 3260.
BACKGROUND INFORMATION: The Legacy Estates, Unit No. 1, subdivision is located north of
Harney Lane, east of Lower Sacramento Road, and south of
DsBennedetti Park. The developer, FCB Building Partners II,
entered into an improvement agreement with the City on
November 24, 2003. Terms of the improvement agreement required the installation of certain public
improvements, including the public sewer trunk line in Harney Lane, to serve the proposed subdivision
and other properties (Exhibit A, Site Nos. 9 through 39) inside the Harney Lane Lift Station Service Area.
The public improvements also include the frontage improvementsfor 2139 West Harney Lane
(Site No. 14) on Legacy Way and Harney Lane and future water and sewer extensions benefiting the
properties northwest of the Legacy Estates, Unit No. 1 (Site Nos. 23, 24, and 25).
The developer has requested a reimbursement agreement and establishment of an area of benefit in
conformance with Chapter 16.40 of the Lodi Municipal Code (LMC) for those improvements that benefit
the neighboring properties.
The property owners within the area of benefit have been notified. The developer has paid the
appropriate applicationfee and the fees to cover the cost of the recording the reimbursement agreement.
A copy of the itemized costs for the reimbursable improvements is attached as Exhibit S. The acreages
and site numbers used in the reimbursement calculation are consistent with acreage and site numbers
established in the previously -adopted Area of Benefit for the Harney Lane Sewer Lift Station
Improvements (RA -03-04).
Pursuantto LMC 16.40, staff recommendsthat Council set a public hearing to establish an area of
benefit and reimbursable costs to recoverthe cost of public improvements benefiting the properties as
shown on ExhibitA. The reimbursable costs for the properties are presented in Exhibit C.
Pursuantto LMC §16.40.50.A.3, the reimbursable amount shall be recalculated annually to include an
amount attributable to interest, using the Engineer News Record (ENR) 20 Cities Construction Cost
index. Similar adjustments to the reimbursable costs will be made each January until payment is

received. In the event that the benefiting properties shown on ExhibitA develop, the City will collect the
appropriate amounts from the developers of the benefiting property and reimburse the developer. The
charges for a benefiting property shall be paid in full at the time of the first development on that property.
The reimbursement agreement expires 15 years after adoption.
In conformance with LMC 16.40, staff recommends that Council set a public hearing to establish an area
of benefit and reimbursable costs to recover the cost of public improvements from the benefiting
properties.
FISCAL IMPACT: None.
FUNDING AVAILABLE: Applicant fees and reimbursement fees collected from future development.

Enclosed is a copy of background information on an item on the City Council agenda of
