AGENDA TITLE: Adopt Resolution Accepting Improvements at 1175 South Guild Avenue
MEETING DATE: June 1,2005

RECOMMENDED ACTION: That the City Council adopt a resolution accepting the development
improvements at 1175 South Guild Avenue.
BACKGROUND INFORMATION: Improvements at 1175 South Guild Avenue have been completed in
substantial conformance with the requirements of the improvement
agreement between the City of Lodi and Kubota Tractor Corporation,
as approved by the City Council on November 17, 2004, and as
shown on Drawings No. 004D015-01 through 004DO15-11.
The improvements include installation of master plan storm drain facilities and sewer pipes in
Auto Center Drive and master plan water pipes in Guild Avenue and Auto Center Drive, as well as street
pavement improvements, curb, gutter, and sidewalks, hydrants and street lights on Auto Center Drive
and Guild Avenue. The developer is entitled to reimbursement by the City for the installation of master
plan storm drain pipes, oversize master plan water pipes, and excess width street pavement
improvements in Guild Avenue, in conformance with LMC 15.64 Development Impact Mitigation Fees
and 16.40 Reimbursementsfor Construction. All reimbursements will be made when the improvements
are complete and accepted by the City.
The street improvements being accepted at this time are:

FISCAL IMPACT: There will be a slight increase in long-term maintenance cost. Funds for
the reimbursements are already appropriated.

RESOLUTION NO. 2005-105
A RESOLUTION OF THE LODI CITY COUNCIL
ACCEPTING DEVELOPMENT IMPROVEMENTS
INCLUDED IN THE IMPROVEMENTAGREEMENT
FOR 1175 SOUTH GUILD AVENUE
The City Council of the City of Lodi finds:
1. That all requirements of the Improvement Agreement between the City of Lodi and
Kubota Tractor Corporation for the improvements at 1175 South Guild Avenue have
been substantially complied with. The improvements are shown on Drawing
Nos. 004D015-01 through 004DO15-11 on file in the Public Works Department and as
specifically set forth in the plans and specifications approved by the City Council on
November 17,2004; and
2. That the developer is entitled to reimbursement by the City for the installation of master
plan storm drain pipes, oversize master plan water pipes, and excess width street
pavement improvements in Guild Avenue in the amount of $89,410, in conformance with
Lodi Municipal Code §15.64, Development Impact Mitigation Fees, and 516.40,
Reimbursements for Construction, from funds previously appropriated; and
3. The streets to be accepted are as follows:
