AGENDA TITLE: Adopt Resolution Accepting Improvements at 1333 East Kettleman Lane

RECOMMENDED ACTION: That the City Council adopt a resolution accepting the development
improvements at 1333 East Kettleman Lane.
BACKGROUND INFORMATION: Improvementsat 1333 East Kettleman Lane have been completed
in substantial conformance with the requirements of the
improvement agreement between the City and Dennis W. Plummer,
as approved by the City Council on October 15,2003, and as shown
on Drawings No. 003DO30-01 through 003D010-15.
The improvements include the installation of a master plan storm drain line in Kettleman Lane and
Auto Center Drive and installation of master plan water mains in Kettleman Lane, Pixley Parkway, and
Auto Center Drive, as well as street pavement improvementson Kettleman Lane. The developer is also
entitled to reimbursement by the City for the installation of master plan storm drain facilities, excess width
street pavement improvements in Kettleman Lane, and oversize water mains in conformance with
LMC 15.64 Development Impact Mitigation Fees and 16.40 Reimbursements for Construction. The
developerwill be reimbursed upon acceptance of these improvements by the City Council.
The street improvements being accepted at this time are:

FISCAL IMPACT: There will be a slight increase in long-term maintenance cost. Funds for
the reimbursementsare already appropriated.

IMF —Water Improvements (182) $ 7,500
IMF — Storm Drain Improvements (326) $ 106.000

A RESOLUTION OF THE LODI CITY COUNCIL
ACCEPTING DEVELOPMENT IMPROVEMENTS
INCLUDED IN THE IMPROVEMENT AGREEMENT
FOR 1333 EAST KETTLEMAN LANE
The City Council of the City of Lodi finds:
That all requirements of the Improvement Agreement between the City of Lodi and
Dennis W. Plummer for the improvements at 1333 East Kettleman Lane have been
substantially complied with. The improvements are shown on Drawing
Nos. 003DO30-01 through 003D010-15 on file in the Public Works Department and as
specifically set forth in the plans and specifications approved by the City Council on
October 15,2003; and
That the developer is entitled to reimbursement by the City for the installation of master
plan storm drain facilities, excess width street pavement improvements in Kettleman
Lane, and oversize water mains in the amount of $261,500, in conformance with Lodi
Municipal Code §15.64, Development Impact Mitigation Fees, and 516.40,
Reimbursements for Construction, from funds previously appropriated; and
3. The streets to be accepted are as follows:
