AGENDA TITLE: Adopt Resolution Authorizing City Manager to Authorize Payment for
City of Lodi/Lodi Unified School District Wash Bay Engineering to
T. Mitchell Engineers and Associates of Oakland (;20,000) and
Appropriate Funds

RECOMMENDED ACTION: That City Council adopt a resolution authorizing the City Manager to
authorize payment for the City of Lodi/Lodi Unified School District
Wash Bay Engineering to T. Mitchell Engineers and Associates of
Oakland and appropriate funds as shown below.
BACKGROUND INFORMATION: This project is a joint effort between the City of Lodi and the
Lodi Unified School District (LUSD). The City of Lodi and LUSD will
share the cost of the project. The City of Lodi has previously
purchased the equipment ($151,455) and has been responsible for
the engineering on this project. LUSD is overseeing construction and has committed to the funding of it.
On November 15, 2000, the City Council approved a joint -use agreement with LUSD and entered into a
design agreement with Booker Gery Hickman Architects.
The project was designed and bid, however, the bids received were well over the amount of the available
funding. At the April 16, 2003, meeting, the City Council rejected all bids and directed staff to redesign
and rebid the project, allowing that the metal building/structure be either eliminated, reduced in scope, or
bid as an alternate. As part of that effort, the City terminated its contract with Booker Gery Hickman
Architects (after the architect for the project left) and, under advisement of the then City Manager, agreed
to move forward with T. Mitchell Engineers to complete the project. T. Mitchell Engineers was selected
for their familiarity with the project and project location (they were the engineering firm for the City of
Lodi/LUSD CNG Project) and their willingness to accept the existing plans for modifications without
requiring a complete re -design. This engineering work is now close to completion and staff is asking for
authorization to pay the engineering firm for their work.

RESOLUTION NO. 2004-244
A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING
THE CITY MANAGER TO AUTHORIZE PAYMENT FOR CITY OF LODI/
LODI UNIFIED SCHOOL DISTRICT WASH BAY ENGINEERING TO
T. MITCHELL ENGINEERS AND ASSOCIATES, AND FURTHER
AUTHORIZING APPROPRIATION OF FUNDS
WHEREAS, this project is a joint effort between the City of Lodi and Lodi Unified School District
and will share costs as outlined in the joint -use agreement between the City of Lodi and Lodi Unified
School District approved on November 15, 2000; and
WHEREAS, also on November 15, 2000, the City Council approved entering into a design
agreement with Booker Gary Hickman Architects; and
WHEREAS, the City of Lodi previously purchased the equipment in the amount of $151,455 and
has been responsible for the engineering on this project; and
WHEREAS, Lodi Unified School District is responsible for overseeing construction and has

NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize
payment for City of Lodi/Lodi Unified School District Wash Bay Engineering to T. Mitchell Engineers and
Associates, of Oakland, California; and
BE IT FURTHER RESOLVED that the Lodi City Council hereby approves appropriating funds not
to exceed $20,000 from Transit Fund 1250.
