AGENDA TITLE: Continue public hearing to December 15, 2004 to consider an appeal
received from Key Advertising, Inc., regarding the Planning Commission'
decision to deny the request of Key Advertising for a Use Permit to allow
76 -foot -high electronic display sign and a Variance to double the maximu
allowable sign area from 480 square feet to 960 square feet to be located

RECOMMENDED ACTION: That the City Council continue until December 15, 2004 the
request of Advertising, Inc., regarding the Planning Commission's
decision to deny the request of Key Advertising for a Use Permit
to allow a 75 -foot -high electronic display sign and a Variance to double the maximum allowable
sign area from 480 square feet to 960 square feet to be located at 1251 South Beckman Road.
BACKGROUND INFORMATION: At the City Council meeting on April 21, 2004, the City
Council continued this matter in order to prepare a
Development Agreement to accommodate the appellant's
request. A draft of the Development Agreement was submitted to the City by the appellant's
counsel. The Community Development Director and City Attorney have reviewed the document
and are working with Key Advertising on changes to provide an agreement that will meet Council
expectations. As this item will require the review and recommendation of the Planning
Commission, we are unsure of how long the process will take.
Staff is recommending that the City Council continue the matter to December 15, 2004.

RE: Key Advertising Use Permit Appeal a- Request for Continuance
Dear Susan
I am requesting a, continuance, (again!?!), for our appeal of the Planning Connnission's
denial of Key Advertising's request for a» perynit to allow a 75' electronic display
sign. This request is due to the City Attorney not completing his review of the proposed
development Weement as directed by past Council action.
1 am hopeful that our appeal can be heard in the very near future, as we have been
delayed for several months now.

On Thursday, September 16, 2004, in the City of Lodi, San Joaquin County,
California, a copy of a Notice of Public Hearing to consider an appeal received from
Key Advertising Inc., regarding the Planning Commission's decision to deny the
request of Key Advertising for a Use Permit to allow a 75 -foot -high electronic display
sign, and a Variance to double the maximum allowable sign area form 480 square -
feet to 960 square -feet to be located at 1251 South Beckman Road. (attached hereto,
marked Exhibit "N'), was posted at the following four locations:
